User Agreement & Terms and Conditions
Monthly Subscription Plan & Annual Plan

IMPORTANT: READ CAREFULLY BEFORE ACCESSING OR USING ANY MATERIALS ASSOCIATED WITH THE ALLSET™ MASTERY PROGRAM.

BY ACCESSING OR USING THE PROGRAM(S), YOU REPRESENT, WARRANT, AND AGREE THAT:

• YOU HAVE READ THIS AGREEMENT IN FULL;
• YOU UNDERSTAND ITS TERMS;
• YOU ACCEPT AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT.

IF YOU DO NOT AGREE, UNDERSTAND, OR ACCEPT THIS AGREEMENT, DO NOT ACCESS OR USE ANY MATERIALS OR SERVICES ASSOCIATED WITH THE ALLSET™ MASTERY PROGRAM AND CONTACT US IMMEDIATELY AT rachel@blackswanteam.com

Section 1: Membership and Program Fees

1.1 Program Description

ALLSET™ Mastery Program (“Company”) agrees to provide educational coaching services in the form of webinars, live workshops, audio and/or visual presentations, PDF/Word documents, group coaching, and related materials (“Program(s)”) in exchange for the applicable Program Fee. The ALLSET™ Mastery Program is a proprietary system designed to integrate Skillset, Mindset, Heartset, BODYSET™, and Soulset into a cohesive operating framework for personal and professional alignment.

1.2 Program Fee Options

YOU agree and understand that Program Fees are governed by the plan selected at the time of enrollment. Two payment options are available:

Option A — Monthly Subscription Plan:

• A recurring monthly subscription fee charged on the same date each month from the date of initial enrollment.
• Access to the Program continues on a month-to-month basis for as long as the subscription remains active and payments are current.
• YOU may cancel your monthly subscription at any time in accordance with Section 1.4 of this Agreement. Cancellation will take effect at the end of the current billing cycle, and no further charges will be applied after that date.
• No partial refunds will be issued for unused days within a billing cycle.

Option B — Annual  Plan:

• A lump sum payment for twelve (12) months of access to the Program. 
• Your Annual Plan will renew each year automatically at the same rate unless you cancel or advise us that you would like to cancel, prior to your enrollment anniversary.
• Access to the Program continues on a year-to-year basis for as long as the subscription remains active and payments are current.
• The initial Annual Plan fees are non-refundable under any circumstances once payment has been processed. If a renewal of your Annual Fee is processed and you did not cancel in time, it can be refunded with a 5% fee for up to 30 days after renewal. 
• Access to the Program will remain active for each full twelve-month term regardless of participation level.

1.3 No Refunds — Initial Annual Plan

By enrolling in the Annual Plan, YOU acknowledge that all Program Fees are earned in full upon payment and are strictly non-refundable. YOU waive any right to initiate a chargeback, reversal, or dispute of payments made. In the event of a credit card dispute, this Agreement will be presented as conclusive evidence of your acceptance of the no-refund terms. Failure to utilize Program materials does not entitle YOU to a refund.

1.4 Monthly Subscription Cancellation Policy

Monthly subscribers may cancel their subscription at any time by contacting the Company at rachel@blackswanteam.com or through the customer billing portal associated with your account. The following terms apply upon cancellation:

• Cancellation will be processed and effective at the end of the current billing cycle in which the cancellation request is submitted.
• YOU will retain access to Program materials through the end of the paid billing period.
• No partial refunds will be issued for the remainder of the billing cycle in which cancellation occurs.
• Once a subscription is canceled, it cannot be reinstated. To regain access, YOU must re-enroll in the Program at the then-current rate.
• Failure to cancel prior to the next billing date will result in a charge for that billing cycle, which is non-refundable.

1.5 Failed Payments — Monthly Subscription

If a monthly payment fails or is declined, Company reserves the right to suspend access to the Program until payment is successfully processed. Repeated failed payments may result in cancellation of the subscription. YOU are responsible for maintaining valid and current payment information on file.

1.6 Promotional Material

By participating in the ALLSET™ Mastery Program, YOU grant Company the right to use testimonials, written statements, images, or recordings referencing your participation for marketing and promotional purposes, unless YOU submit a written opt- out request to rachel@blackswanteam.com.

Section 2: Disclaimers & Limitations

2.1 Educational Purposes Only

The Program is provided solely for educational and informational purposes. It does not constitute legal, medical, financial, tax, or business advice. YOU are solely responsible for how you use or do not use the information provided. Results will vary based on individual effort, background, and circumstances.

2.2 No Physician-Patient Relationship

While Dr. Elaine Stageberg, MD, MHA is a licensed physician in Minnesota, Dr. Ted Lin is a licensed physician in Colorado, and including all other licensed physicians or other professionals who may present in the Program, this Program does not create, and shall never create, a physician-patient relationship. No medical diagnosis, treatment, or  individualized medical advice will be provided. If YOU have medical or mental health concerns, YOU agree to seek independent care from a licensed healthcare provider outside of this Program.

2.3 No Guarantees of Results

The Program makes no guarantees or warranties of specific outcomes, earnings, health improvements, business success, or personal results. Examples, testimonials, and case studies shared within the Program are illustrative only and are not promises of future performance. YOU acknowledge that YOU may experience no results or outcomes different from those described.

2.4 Limitation of Liability

To the fullest extent allowed by law, Company, its owners, officers, employees, and affiliates shall not be liable for any damages of any kind, including direct, indirect, incidental, consequential, or special damages, arising out of or relating to the Program or your participation in it.

2.5 Assumption of Risk

By enrolling, YOU expressly assume all risks related to decisions you make regarding health, investing, business, relationships, or any other aspect of your life as a result of your participation in the Program. YOU accept full and sole responsibility for your outcomes.

Section 3: Confidentiality & Intellectual Property

3.1 Confidentiality

Access to the Program is personal to YOU only. Sharing of login credentials, materials, session recordings, or any Program content with any third party is strictly prohibited. Any breach of this section may result in immediate termination of your access without refund.

3.2 Intellectual Property

All Program content, including but not limited to the ALLSET™ Framework, BODYSET™ system, course materials, recordings, workbooks, and related intellectual property, is owned exclusively by Company. YOU receive a limited, revocable, non- transferable license for personal use only. No rights are granted to copy, reproduce, share, distribute, sell, or create derivative works from any Program materials.

Section 4: Miscellaneous

4.1 Non-Transferability

Enrollment in the ALLSET™ Mastery Program is personal to YOU and cannot be transferred, gifted, or assigned to any other individual under any circumstances.

4.2 Indemnification

YOU agree to indemnify, defend, and hold harmless Company, its officers, employees, contractors, and affiliates from any claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising out of or related to your participation in the Program, your violation of this Agreement, or your violation of any rights of another party.

4.3 Entire Agreement

This Agreement constitutes the full and complete understanding between the parties with respect to the subject matter herein and supersedes all prior agreements, representations, or understandings, whether written or oral.

4.4 Amendment
Company reserves the right to amend this Agreement at any time by posting an updated version online or providing notice to enrolled participants. Continued participation in the Program following notice of any amendment constitutes acceptance of the revised terms.

4.5 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

4.6 Legal Expenses

In the event of legal action to enforce this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and associated costs from the non- prevailing party.

4.7 Severability

If any provision of this Agreement is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of this Agreement shall continue in full force and effect.

Acknowledgment & Signature

By signing below, YOU acknowledge that you have read, understood, and agreed to all of the terms of this Agreement, including the payment and cancellation terms applicable to your selected plan, the no-refund policy for Annual Plan enrollees, the educational purpose disclaimer, the no physician-patient relationship clause, the waiver of liability, and your commitment to the terms as outlined herein.
